1. Accounts

Examiners: Ability to create and assign exams to specific users or groups

Account Termination

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, particularly in cases of:

Violation of these Terms
Providing false or misleading information
Engaging in fraudulent or illegal activities
Extended periods of inactivity
Using the Service to harm others or spread misinformation

2. Acceptable Use

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service.

Prohibited Behaviors

Reverse engineering or decompiling any parts of the Service

Consequences of Violation

Violation of these acceptable use guidelines may result in:

Temporary or permanent suspension of your account
Removal of content you've created
Restriction of certain features or privileges
Legal action in severe cases

3. Content and AI-Generated Material

3.1 User-Generated Content

Our Service allows you to create, upload, and share content. You retain all rights to content you create, but grant us a license to use, modify, and display that content for the purposes of providing the Service.

You are solely responsible for the content you create, including custom exams, notes, and other materials. You represent and warrant that:

You own or have the necessary licenses, rights, consents, and permissions to use and share the content
Your content does not violate any rights of any third party (including copyright, trademark, privacy, or other personal or proprietary rights)
Your content does not contain material that is defamatory, obscene, threatening, invasive of privacy, or otherwise objectionable
Your content does not violate any applicable laws or regulations

Content License

By posting content on PrepareBuddy, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service and our business operations, including for promoting and redistributing part or all of the Service.

This license continues even if you stop using our Service, but only for content that was already shared while you used the Service.

3.2 AI-Generated Content

Many features of PrepareBuddy use artificial intelligence technologies to generate content. This includes exam questions, study materials, personalized feedback, and other educational resources.

AI Limitations and Disclaimer

You understand and acknowledge that:

AI-generated content may occasionally contain errors, inaccuracies, or inappropriate content despite our best efforts to prevent such issues
We cannot guarantee the accuracy, reliability, or suitability of AI-generated content for any particular purpose
You use AI-generated content at your own risk, and should verify information with authoritative sources before relying on it for critical purposes like official exams
The AI may occasionally misinterpret instructions or provide incomplete answers
We are not liable for any consequences resulting from your use of or reliance on AI-generated content

AI Ethics and Improvement

We are committed to continuously improving our AI systems to make them more accurate, reliable, and helpful. To do this, we may:

Review anonymized interactions with the AI to identify and fix issues
Deploy updates to enhance content quality and relevance
Implement safeguards against misinformation and inappropriate content

4. Intellectual Property

5. Exam Results and Certification

Our completion certificates are for motivational and record-keeping purposes only, and should not be presented as official qualifications.

Practice Materials

Our exams are designed to mimic official tests, but we do not claim they perfectly represent official certification exams in content or structure.

No Pass Guarantee

While we strive to provide high-quality preparation materials, we cannot guarantee that using our Service will result in passing official certification exams.

Appropriate Certificate Usage

PrepareBuddy certificates may be used for:

Personal achievement tracking
Demonstrating study commitment to teachers or employers
Sharing progress with study groups or mentors
Supporting applications, provided they are clearly identified as practice achievements

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall PrepareBuddy, its affiliates, or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the Service or the provision of or failure to provide support services, even if PrepareBuddy has been advised of the possibility of such damages.

In all cases, PrepareBuddy's entire liability under any provision of these Terms shall be limited to the amount actually paid by you for the Service or USD $100.00, whichever is less.

Inaccuracies in exam content or AI-generated materials
Service interruptions or technical issues

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. PrepareBuddy expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

PrepareBuddy makes no warranty that:

The Service will meet your requirements
The Service will be uninterrupted, timely, secure, or error-free
The results that may be obtained from the use of the Service will be accurate or reliable
The quality of any exams, information, or other material obtained by you through the Service will meet your expectations
Any errors in the Service will be corrected

Educational content, including practice questions and explanations, is provided for general informational purposes only. While we strive for accuracy, we do not warrant that the educational content is error-free or will be applicable to your specific academic or certification needs.

8. Modifications to Service

PrepareBuddy reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third-party for any modification, suspension, or discontinuance of the Service.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
